This raffle will benefit Sprint for Sight, Inc.

The actual drawing will be held on Saturday, June 27, 2009.  The exact location has of the drawing has not been determined.  The drawing will be supervised by Dennis Conley, CPA.  Winner need not be present to win. By entering the raffle, each contributor  agrees to be fully and unconditionally bound by these Official Rules and the rules set forth by James R. Evans, P.A. and the state of Florida’s interpretation thereof.  By making a contribution and accepting the opportunity to win the home offered herein, each contributor hereby releases James R. Evans, P.A. and Sprint For Sight, Inc. and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies from any and all liability in accordance with Florida law and acknowledges that he or she has had ample opportunity to seek independent legal advice prior to making said contribution and agreeing to be bound by these terms.

1. ELIGIBILITY. Drawing open only to opersons age 18 or older at the time of entry to purchase tickets, be a ticket holder, or win a prize. An affidavit of eligibility, photo identification, taxpayer identification number, and other information will be required from prizewinners. Void where prohibited. This is not a lottery, this is a drawing by chance. All applicable federal, state and local laws and regulation apply.  The value of all prizes awarded will be reported to tax authorities as income. No mechanically or electronically reproduced entries accepted.

1.1 The following individuals, and immediate family members (defined as spouse, IRS dependent, or step- or biological mother, father, sister, brother, daughter or son) of, or who reside in the same household as, any person in any of the following categories, are not eligible to participate:

• Employees of James R. Evans, P.A. 

• Any person who was or is a director, officer, employee, or agent of Sprint For Sight, Inc.

• Any person engaged in the development, production or distribution of materials or prize supply for the Raffle

• Any person who resides in any area where this Raffle, game by chance, would otherwise be prohibited by law.

2. HOW TO PURCHASE

To enter, a ticket may be obtained from James R. Evans, P.A or Sprint For Sight, Inc.  Purchase Confirmation printouts are NOT certified Raffle Tickets and will NOT be redeemed as such.  Only the actual E-ticket or hard copy, whichever you request, are eligible to be presented for the prize(s).

Purchase may be made on one of our internet websites - www.sprintforsight.com or www.sunshinestatehomeraffle.com, By Phone by calling 386-492-8473 and providing information requsted. or by Mail (if available) please send check or money order or credit/debit card information (made payable to Sprint For Sight, Inc.) to: 2009 Debary Home, Sprint For Sight, Inc., 322 Silver Beach Ave., Daytona Beach, FL  32118. When purchasing a Raffle Ticket via mail, you must provide a valid email address, full legal name, age, home phone, alternate phone, physical address, mailing address, number of tickets you wish to purchase and payment method, include a US Postal Money Order or check for the exact amount, or credit card information including expiration date and billing address.  Tickets and payment confirmation will be sent electronically, email only. To obtain a hard/paper copy of an original raffle ticket, send a self-addressed, postage paid (SASE) envelope and the ticket will be mailed to you.  When ordering on-line, be sure to click the final purchase button only once, additional or repetitive clicks of the final purchase button will result in double charging your account, doubling your order, and this error is not the responsibility of James R. Evans or Sprint For Sight, Inc.

All ticket requests will be processed in the approximate order in which they are received. The fee for any ticket purchase is not tax deductible in accordance with IRS regulations. No refunds are available and all ticket sales or donations are final.

2.1 Ticket(s). Tickets are $100 each, suggested minimum donation.  No refunds or exchanges. No credit card charge backs, or disputed charges to entrant’s credit card company regarding a valid entry payment, by any entrant, this will void entry and a service fee of $39 will be charged to the entrant’s credit card for this service. Odds of winning are one in 5,000 for each ticket purchased.  All federal, state and local taxes associated with receipt or use of prize, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the Winner. Winner must claim prize by executing  an affidavit of eligibility and acceptance of these Official Rules and release of liability and a completed W-9 form, or other form as required by law, to James R. Evans, P.A. and Sprint For Sight, Inc.  no later than 5:00 p.m. EST thirty (30) calendar days from announcement or first attempt at contact, or the prize will be forfeited and awarded to alternate winner, see section (4). Prize not transferable. No substitutions or exchanges (including for cash). Actual prize may vary from photos used in print. No purchase necessary.  Void where prohibited.  Contributor need not be present to win.  Winner determined by random drawing from all eligible entries, to be held at on Saturday, June 27, 2009.  The exact location of the drawing will be announced at a later date.  The drawing will not be cancelled.   James R. Evans, P.A. will notify winner by telephone or email and U.S. certified mail return receipt on drawing day. To claim prize, winner must follow the instructions contained in their notification. Winner must present two (2) forms of proper ID, one must be a valid State-issued driver’s license or Identification certificate or such other form as will provide proof the entrant’s US residency (e.g., voter registration card, etc.) see section 4 below. False entries or entries suspected of being false, and any illegible, defective, incomplete or physically altered Entry Forms and entries that do not include valid or complete payment as directed will be disqualified. James R. Evans, P.A. and Sprint For Sight, Inc. not responsible for printing errors in any Raffle-related material, or for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of James R. Evans, P.A. and will not be returned.

3. SELECTION OF WINNER.

Drawings. The drawing will be conducted by a representative of a 501c (Sprint For Sight) organization as described below and held under the supervision of an independent accounting firm. Entrants need not be present to win. All tickets will be verified by an independent, third-party accounting firm. The winner will be notified by telephone, email and certified mail, return receipt requested, information as provided at ticket purchase. Notification by telephone will be made day of drawing. Email and U.S. certified mail, return receipt notification will be made within 24 hours of drawing.

3.1 DRAWING: June 27, 2009. All entries must be received by June 27, 2009 one hour before the drawing to be eligible. GRAND PRIZE: The Grand Prize is the home located at: 380 Magnolia Springs Court, Debary, FL  32713, The Grand Prize Winner assumes all fees, local, state and federal taxes, home owners’ association fees and transfer taxes and shall reimburse James R. Evans, P.A. and Sprint For Sight, Inc.  for any fees associated with transfer of the Grand Prize home.  Closing costs, title insurance and 2009 property taxes (up to and including the date of the drawing) not responsibility of winner. A W-9 form must be completed by winner. Any withholdings, if required, applicable to prize will be required at the time of transfer of such prize to the winner. No warranties, express or implied, are made or offered by James R. Evans, P.A. or Sprint For Sight, Inc.  The home is provided “as is” with no guarantees or warranties.  Cash prizes will be delivered to Selected Entrant by U.S. registered mail or overnight carrier to the name and address provided on the Entry form. Payment will be done in the form of a check made payable to the name provided on the Entry Form. No substitution or transfer of prizes. Entrant will have (180) calendar days from receipt to deposit or “cash” the cash prize, the issued check.  Early Bird One and Two drawings cash prize redemption procedure is listed below.  All prizes may be subject to tax withholding. Winners are advised to consult a professional tax advisor. Model home interior decorating and furnishings and artists renderings are for display purposes only and are not included as part of the Grand Prize. Custom choices and upgrades are not available.  No guarantees are made as to the value of the home at the time it is awarded or that the winner will be able to sell the home for the amount provided for tax purposes. Tax authorities may place a different value on the home for the purpose of determining any income, property, transfer or other taxes that may be due from the Grand Prize winner. If any prize winner cannot be located by 5 p.m., thirty (30) calendar days after the announcement or thirty (30) days of prize notification, which ever is greater, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited his/her prize and another winner will be selected for such prize. A list of winners may be obtained by writing to James R. Evans, P.A. at 322 Silver Beach Avenue, Daytona Beach, FL 32118 or by visiting this web site where the list will be posted approximately within 24 hours after final drawing, or by calling 1-386-492-8473 24 hours after the drawing is conducted. Requests in writing must be received or postmarked within seven days of the drawing and include a self addressed, stamped envelope. The IRS has decided that amounts paid for chances in raffles, lotteries or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions.

4. NOTIFICATION.

The winner will be notified by phone and/or U.S. Mail using the information provided on the Entry Form or to the operator (“Notification”). If any Selected Entrant cannot be located or fails to return attempts to contact him or her by 5:00 p.m. thirty (30) days after Sprint For Sight's  first attempt to contact him or her, such Selected Entrant will be deemed to have forfeited his or her prize and another Selected Entrant will be drawn. Each Selected Entrant must execute an affidavit of eligibility / liability / terms and conditions / publicity release (“Release”). Selected Entrant(s) must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same Entrant named on the winning Ticket, credit card used to purchase ticket. Unless restricted by law, each Selected Entrant will be required to complete and return the Release within thirty (30) days of prize notification. The prize may be forfeited if Selected Entrant(s): (I) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. Winner must execute all required documentation to transfer title of property into his or her name, within the (30) days of prize notification. Winners grant permission for the use of their names, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law. In the event any selected entrant is found ineligible or forfeits the prize, as described in these official rules, an alternate drawing will be held within five (5) business days after verification the selected entrant is found ineligible, rules of alternate drawing governed by these official rules, and notification will be posted on the website immediately.

5. GENERAL TERMS AND CONDITIONS.

By entering the drawing, the entrant agrees to be bound by these Official Rules and the decisions of the Sprint For Sight, Inc., which shall be final. Winners will be required to execute an affidavit of eligibility and a publicity release permitting Sprint For Sight, Inc. and James R. Evans, P.A. to use their name, photograph, likeness and voice for promotional purpose in any media. All winners are required to present proof of identity satisfactory to Sprint For Sight's sole discretion that matches the name on the winning ticket. Neither Sprint For Sightl, James R. Evans or any Sponsor or any of its subsidiaries, affiliated companies, franchisees, service agencies, officers, directors, shareholders, members, representatives, or independent contractors or any of its affiliates are responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. Winner agrees to defend, indemnify and hold Sprint For Sight, Inc.,  James R. Evans, P.A. and/or Sponsors and each of their respective officers, directors, shareholder, employees, agents and affiliates and identities, harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of the prize. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE RAFFLE. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. PRIVACY.
